Super Mario 63's listing 2025-02-21 19:39:45

Did I miss something? I went looking for SM63 (for nostalgia's sake) and I noticed it was no longer in my favorites and the URL that google links to leads to an unpublished submission page. What happened? Was it taken down?

Sometimes older games get converted into versions that will work on Ruffle emulation.

Maybe we can ask @olskoo and see if he knows anything.

Perhaps its being processed or something

This is the link, if im not mistaken (showing unpublished)

I think it was taken down

I know that Tom mentioned recently that takedown notices have been increasing lately and a few days ago Super Gangsta Mario was also taken down.

Although N has every right to do this, it is unbearable how inconsistent they are in how they deal with their IPs being used! Not long ago they have requested that all related submission on Garry's Mod's workshop were removed. Every single one!! And here they seem to be cherry picking submissions. How revolting!

we really can't have nice things

that game was alive for what feels like almost 2 decades

i'm going to mourn its death from here (probably still fine in runouw's site, and it is also in archive.org like blake mentioned)

Nintendo is starting to make contracts with many copyright protection companies such as MarkMonitor (the same one behind the GMOD burnout alongside other rom sites like Vimm's Lair). Those companies will become a much bigger pain in the ass for fan-creators in the near future.

It's so weird what gets taken down. Super Mario 63 for example is doing nothing weird in the Mario brand (unlike Super Gangsta Mario) yet it got taken down. Then big stuff like Super Smash Flash 2 or Super Mario Bros. CD can do their thing without a problem.

guess brand protection bozos like markmonitor don't care and just strike everything they see. like, what damage does it do to nintendo for a sandbox game to have FAN CREATED models of their IP (gmod case)

they're not even asking for money, and neither was SM63, nothing was driving sales down

This is why we should change copyright so big companies can't bully the fuck out of fandoms because it uses their intellectual property.

Don't you dare mansplain me why copyright law exists, because we get it, people should have rights to use their own property they made, but a big problem is that companies like Disney or Viacom just abuse it to the most ridiculous degree. What's that? A YouTube Poop where Spongebob kills Patrick? Fuck FAIR USE, let's copyright strike it down. Nintendo, on the other hand, would like to shove $60 prices on re-released video games that barely have new content other than it's cheaper than the disgusting, phallic market that is secondhand copies (And consoles mind you.). I get not wanting to buy a secondhand copy of Pokemon SoulSilver because it's Brazilian economics but it's in the US, but I can't get buying Super Mario 3D-Stars if emulation exists and I own either a Steam Deck OR the games included. Not to mention fans of the works can be used as a way to make games as well. Christian Whitehead is proof of this since his work is used for porting Sonic CD and the Genesis Sonic titles (Minus 3 & Knuckles.), along with Sonic Mania. Of course, THIS is an exception and not the norm. Because otherwise, Arin Henson should never be allowed on the development team for any Sonic game.

I'm no US lawyer nor one that dabbles in copyright law, so seriously do not take my word as a lawyer and do your research on the matter from actual legal professions (Since it's bad enough people abuse it AND misinform, cough cough, Lily Orchard/CD-Call.), but Nintendo has the right to do so when they're the publisher and mods for Garry's Mod when they use content from the developers they work with. It's legally hard to argue that uploading a mod for Garry's Mod that contains a 3D model of Mario that was ripped from Super Mario Galaxy for fair use. Just because it's non-profit doesn't mean it's exempt from copyright infringement and that's because the loss of sales isn't a factor of this matter. What it IS a factor for is for damages if found guilty. What's exactly fair use when you do take a 3D model from Super Mario Galaxy and use it as merely a playermodel or ragdoll mod? Companies like Nintendo aren't going to give you a green light for something like a mod, let alone in a game where Mario can be realistically hurt by guns, resulting in blood stains. Money does not matter because it's not a factor of fair use in the first place.

its better off to download swf files and then convert them into a .exe

or you can just go to runouw website and there download working standalone flash executable sm63

Are we sure that it's the real Nintendo and not a copyright troll? Because that kind of thing has happened before. Either way, sucks that it was taken down... It was a part of history, being up for 15 years. Hands-down one of my favorite Mario fangames of all time.
